Data Privacy

With respect to the privacy, security and integrity of data collected from or written to the APS System, Client will comply with all relevant privacy and security related law, including the Gramm-Leach-Bliley Act and its implementing regulations (“GLBA”), and to the extent applicable, the privacy laws of any state, 

To the extent Client obtains access to any nonpublic personal information of a customer of a Qualified End User (“Customer NPI”) pursuant to this Agreement, Client agrees to protect and keep confidential all such Customer NPI except to the extent disclosure is expressly permitted by this Agreement and relevant privacy laws. 

Client shall implement and maintain appropriate safeguards to protect all Customer NPI obtained or accessed pursuant to this Agreement for so long as it has access to such Customer NPI.

Client agrees that, in addition to all of its obligations under this Agreement, Client will not access, store, share, disclose, or use any Customer NPI other than to the extent necessary to carry out the purposes for which the Qualified End User has provided access to the Customer NPI. Client will ensure that Client personnel shall not attempt to access or allow access to any Customer NPI that they are not permitted to access under this Agreement or any agreement with a Qualified End User.
